1. Conclusion of Contract

1.1 Applicability

These terms and conditions apply to all agreements between Casa Eleven (referred to here as “the Company”) and its customers in relation to participation in multi-day retreats, unless otherwise agreed in individual cases.

1.2 Booking and Confirmation

Bookings for Casa Eleven are considered binding. An agreement is formed once Casa Eleven confirms the booking via email. Participation is only guaranteed after the full payment of the retreat fee has been received.

1.3 Eligibility and Age Requirement

Participants must be at least 18 years old at the time of the retreat, unless otherwise agreed in writing.

2. Retreat Details

2.1 Retreat Structure

Casa Eleven offers multi-day retreats in curated locations. The retreats include group classes, private sessions, accommodation, and meals as outlined on the Casa Eleven website or promotional materials.

2.2 Room Sharing & Optional Extras

Rooms are shared by default. A private room can be requested for an additional fee and is only confirmed if explicitly accepted by Casa Eleven. Services not included in the base retreat price include:

  • Flights (must be self-booked by the participant)

  • Airport shuttle

  • Optional massages

2.3 Schedule

  • Check-in: from 16:30 on arrival day

  • Program start: 18:00 on arrival day

  • Check-out: by 10:00 on departure day

  • On arrival and departure days: 1 group class

  • On full days: 2 group classes

  • Each participant is entitled to one 30-minute private session during the retreat

2.4 Food

All meals are included. The menu is vegetarian with optional vegan or fish-based alternatives. Please inform us of any food allergies in advance. While we make every effort to accommodate dietary needs, we cannot guarantee an allergen-free environment.

2.5 Participant Responsibilities

Participants are responsible for:

  • Booking and paying for their own flights

  • Ensuring valid travel documents (passport, visa if required)

  • Having a valid travel and health insurance 

  • Meeting any local health or COVID-related entry requirements

3. Prices and Payment

3.1 Pricing

All prices are final and include applicable taxes.

3.2 Payment Terms

Retreat fees are due in full upon booking unless otherwise agreed. Payment methods include online payment systems (e.g., PayPal, bank transfer).

3.3 Discounts and Promotions

Promotional offers and discounts are only valid during the period stated. Discounts cannot be combined.

4. Cancellation and Refund Policy

4.1 Cancellation by Participant

Participants may cancel their booking at any time. However, a refund is only possible if someone from the waiting list fills the vacated spot. Otherwise, no refund is issued. Participants are encouraged to obtain travel cancellation insurance.

4.2 Non-Attendance

In the event of absence, early departure, or partial participation, there is no right to a (partial) refund.

4.3 Legal Right of Withdrawal

Any statutory cancellation or withdrawal rights remain unaffected.

5. Liability

5.1 Own Risk and Insurance

Participation in all activities during the retreat is at the participant’s own risk. Each participant must have valid travel and health insurance that is accepted in Spain. Participants agree to disclose any relevant medical or physical conditions prior to attending the retreat.

5.2 No Liability

Casa Eleven (Amy Chiara Cath Juliane Marie Kunz one10 GbR) is not liable for:

  • Injuries

  • Health issues

  • Delays or missed flights

  • Weather-related impacts
    The Company is only liable for damages in cases of gross negligence or intentional breach of duty.

5.3 Limitation of Liability

In cases of simple negligence, liability is limited to foreseeable damages related to fundamental contractual obligations.

5.4 Exclusions

These limitations do not apply in cases of injury to life, body, or health, or under mandatory product liability laws.

5.5 Force Majeure

The Company is not liable for non-performance or delays caused by events beyond its reasonable control (e.g., natural disasters, pandemics, strikes, travel bans). In such cases, Casa Eleven reserves the right to modify, postpone, or cancel the retreat.

6. Code of Conduct

Participants are expected to behave respectfully and considerately toward fellow participants, staff, and the venue. Casa Eleven reserves the right to exclude any participant without refund due to:

  • Disruptive behaviour

  • Harassment or abuse

  • Endangerment of self or others

7. Changes to Program

Casa Eleven reserves the right to make reasonable changes to the retreat schedule, instructors, or content due to unforeseen circumstances, provided the overall nature of the experience is not significantly affected.

8. Intellectual Property & Media

8.1 Intellectual Property

All written content, materials, and concepts shared during retreats remain the intellectual property of Casa Eleven and may not be copied or redistributed without written permission.

8.2 Photography and Video

Participants agree that photos and videos taken during the retreat may be used by Casa Eleven for promotional purposes (e.g., website, social media, brochures) without compensation, unless explicitly objected to in writing before the start of the retreat.

9. Data Privacy

Casa Eleven processes personal data exclusively for the purposes of booking, communication, and contract fulfilment. Data is handled in accordance with applicable German and EU data protection laws (including the GDPR).

10. Final Provisions

10.1 Jurisdiction

All legal disputes arising from this agreement are subject to the jurisdiction of Hamburg, Germany.

10.2 Online Dispute Resolution

The European Commission offers a platform for out-of-court online dispute resolution available at: https://ec.europa.eu/consumers/odr

10.3 Applicable Law

German law applies to all contractual relationships, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

10.4 If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
